Terms and Conditions of Proximus Tech Investments Pte. Ltd. (GigaXeSIM)

1. Introductory Provisions

1.1. These Terms and Conditions constitute a legally binding agreement ("Agreement") between you ("User") and Proximus Tech Investments Pte. Ltd., a private limited company established in Singapore, with its registered office at 138 Robinson Road, 24-01, Oxley Tower, Singapore, 068906 ("Proximus", "we" or "us"), regarding your purchase of an international data plan ("Data Plan") associated with a prepaid eSIM ("eSIM"), for use on your personal device ("Device"), provided by Proximus through the GigaXeSIM brand ("Service").

1.2. Future agreements between the User and Proximus may also be subject to additional terms and conditions or documents that may be published on our website or application ("Application").

2. Description of Service and User Registration

2.1. GigaXeSIM is a global eSIM store that makes international connectivity more accessible through eSIM technology. GigaXeSIM offers data packages in many countries, reducing the need for physical SIM cards.

2.2. The User can register to purchase an eSIM through our Application. The User must accept the Terms of Use to register and purchase an eSIM. Proximus’ Privacy Policy and Cookie Policy are displayed in the application when the User registers.

2.3. During the registration process, the following information must be provided: First name, Last name, Email address. This information is required for interactions and transactions on www.gigaxesim.com or within the GigaXeSIM application.

3. Purchase and Activation of Service

3.1. When purchasing an eSIM through the Application, you enter into a purchase agreement with Proximus and agree to pay all applicable fees.

3.2. You are responsible for the eSIM once it is delivered to you. If your device is damaged or lost, you remain obligated to pay the full price of the eSIM.

3.3. You may purchase an eSIM from Proximus’ authorized third-party partners. In that case, the agreement is between you and the third party.

3.4. Proximus may restrict the availability of data plans in certain jurisdictions.

3.5. By using the Service, the User confirms that they have an unlocked device compatible with eSIM.

4. Warranty

4.1. These Terms are in addition to statutory consumer rights.

4.2. Proximus makes no warranties or representations regarding the eSIM or Service, except where required by applicable law.

4.3. Proximus reserves the right to discontinue the sale or support of any eSIM at any time.

5. Service Availability

5.1. Proximus will take commercially reasonable steps to maintain Service availability, subject to network capacity and connectivity.

5.2. Proximus partners with multiple service providers, including network operators.

5.3. "Unlimited" data plans may be subject to fair usage policies imposed by the network provider.

5.4. Proximus does not guarantee: network capacity, network quality, uninterrupted connectivity. Service issues may arise due to maintenance, network gaps, device limitations, regulatory requirements, weather, interference, or other factors beyond our control.

6. Duration and Termination

6.1. This Agreement becomes effective upon purchase of an eSIM.

6.2. The Agreement continues until the data plan expires or available credit is fully used.

6.3. This Agreement terminates immediately if: the User uses or the data plan expires, or, Proximus suspends the User’s access due to violation of these Terms or applicable laws.

6.4. After expiration, the eSIM remains on the User’s device on an "as-is" basis until removed by the User.

7. User Obligations

7.1. The User agrees to: use the eSIM in accordance with these Terms, comply with all applicable laws, not use the eSIM for fraudulent or unlawful activities, not misuse Proximus’ commercial information, not overload the Service with excessive data usage, not infringe third-party intellectual property rights

7.2. The User shall not misuse promotions, credits, or referral programs.

7.3. Proximus may suspend the Service in case of breach; the User remains liable for all associated costs.

7.4. Proximus may delete the User’s account or disqualify them from future promotions.

8. Payment Terms

8.1. Payments are processed by authorized agents of Proximus.

8.2. All eSIMs are prepaid. Prices include indirect taxes unless stated otherwise.

8.3. Indirect taxes include VAT, sales tax, and similar levies.

8.4. Users may save payment methods for future purchases.

9. Statutory Right of Withdrawal

9.1. Consumers may withdraw from the Agreement within 14 days unless the eSIM has been activated, in which case a partial refund may apply.

9.2. To exercise this right, contact Proximus (see Section 18).

10. Refund Policy

Refund rules remain unchanged from the original document; all references now point to Proximus Tech Investments Pte. Ltd.

11. Intellectual Property Rights

All content, trademarks, software, and materials associated with the Application or Service are owned or licensed by Proximus.

12. Data Protection

12.1. By purchasing an eSIM, the User agrees that Proximus will process personal data to provide, improve, and protect the Service.

13. Indemnity

The User agrees to indemnify Proximus, its subsidiaries, affiliates, officers, agents, partners, employees, and service providers for losses resulting from breach of these Terms or misuse of the Service.

14. Limitation of Liability

To the extent permitted by law, Proximus’ liability will not exceed the total fees paid by the User in the previous 12 months or €100, whichever is greater.

15. Governing Law

15.1. Unless mandatory local laws applicable to the User provide otherwise, these Terms shall be governed by and construed in accordance with the laws of Singapore.

15.2. The parties agree that the courts of Singapore shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter.

15.3. Nothing in these Terms shall deprive the User of the protection afforded by the mandatory consumer protection laws of their country of residence, where applicable.

16. Amendments to Terms and Conditions

Proximus may amend these Terms. Updated versions will be published on our website or Application. Continued use of the Service indicates acceptance of changes.

17. Final Provisions

Proximus may assign or transfer its rights under this Agreement. Invalid provisions will be modified or removed while the remainder stays effective.
